The Almuñécar law court has just confirmed that the case against the Mayor over the municipal market underground car park has been permanently shelved – there can be no further appeal.
The court finding is dated the 31st of March and confirms the original decision to shelve the case on December the 28th last year.
The case goes back to May 2015 when the law court accepted a suit brought against Mayor Trinidad Herrera by Hermanos García who had held the lease on the parking said facilities. They accused her of incompliance to the decision passed in a Plenary Meeting of the Town Council to put right state of deterioration to the parking structure.
Substitute Judge Luis Navarro Medina considers that “the perpetration of the [alleged] crime is not apparent nor duly demonstrated,” referring to the plaintiff’s accusation that the Mayor’s inaction was premeditated.
