Scramble Bikers Sentenced

The Juzgado de lo Penal de Granada has passed down a condemnatory sentence against two men for resisting authority.

Well, that doesn’t tell us much but it concerns two scramble-bike riders who thought it would be a good wheeze to cut across the protected natural area of Cerro de Huenes, which is part of the Parque Natural de Sierra Nevada, on the 20th of January, 2024. 

Their activity was tracked by park wardens to the town of Monachil where they were busy loading their trial bikes onto trailers. 

When challenged by the park wardens, they refused to produce their IDs and attempted to jump into their vehicles and drive off but were prevented from doing so with a struggle ensuing. The “resisting authority” springs from this confrontation.

Some of the areas where the greatest presence of this kind of motorbike has been detected are the Sierra del Manar and Cerro Huenes, in the municipalities of Monachil, La Zubia, Dílar and Padul. These same areas are also favourite excursion areas for cyclists, long-distance runners and hikers who  use the existing forest tracks and trails.

With this ruling, “The consideration of ‘environmental agents’ as public authorities is firmly established, reinforcing their authority in defence of the natural heritage of Andalucía.”

Both men will face a six-month fine at six euros a day, giving a total of approximately just over 1,000 euros. They also have to cover court costs between them.
