Restaurant Sues Town Hall

Just across from Casa Emilio, next to the supermarket on Salobreña beach there is a sort of trailer-cum-kiosk restaurant; Simbioremolquea, whose owners are at loggerheads with the Town Hall.

María Isaura Martín, who is the administrator and owner of Conectando Sabores Amigos, is taking the Town Hall to court (criminal law, not civil law) accusing it of prevarication and abuse of power, which is basically the same thing; i.e., using an official position to make an unjust decision.

The reason is that the Town Hall withdrew her licence, which has been running since 2021. As an aside, a couple of years ago they wanted to advertise with us but it never materialised, but they did give me a full explanation of how it worked and a tour of its premises.

Back to the plot, the claimant accuses the Town Hall of withdrawing her licence and giving it to a third party without any legal justification. According to Sra. Martín, the 3rd party in question does not even have the required paperwork in order to have such a licence.

She has backed her case with reports for legal advisors and even the Municipal Secretary, all of which point to an arbitary decision on the party of the Mayor. She says that the Secretary investigate the situation and concluded that the decision violated her constitutional rights.

Recently, the Town Hall rejected her request to open during the Romería (fiestas locales) stating that her petition had no “tourism interest,” despite her having received European funds for precisely that reason.

Finally, according to Sra. Martínez, she has knowledge of twelves other businesses going through the same as her; one of which has been operating for 40 years.

As for the Mayor, Javier Ortega, he says that her claims that she has a licence that allows her to operaate until the end of the years are completely false. He adds that there has never been a licence in her business’s name that permits her to occupy the area that she has been doing.

However, he said that he could not give more specific details as the affair is now a judicial matter.
