The provincial law courts dealt with a case at the end of last month involving two young Romanians that had originally been handled by Motril.
The father of the 13-year-old girl reported her 19-year-old boyfriend for having sex with her, as he was worried that she might become pregnant. Although he did not press charges, the Public Prosecutor did, given her age.
This occurred somewhere on the Costa Tropical, which is why the Motril law courts initially dealt with it. Now, three years later, the accusation and defence came to an accord in which the now 22-year-old man would plead guilty, thus avoid trial.
The appearance before the tribunal (three judges and no jury) didn’t last even ten minutes. The Public Prosecutor had originally recommended ten years for sexual aggression as sexual consent cannot be given under 16 years of age. However, he took into account the attenuating circumstance that there was not much age difference between them at the time; neither mentally or physically.
The man had been living in another European country and had returned for the case before the tribunal and accepted the sentence handed down of a two-year, suspended prison sentence owing to a three-year probationary period. He also has to pay the girl 500 euros in compensation.
