When Winning isn’t Enough

LHR Carmenes del Mar OnLThe 400 affected families in Carmenes del Mar on Cerro Gordo won their case, the judge sentencing the accused to pay for the emergency repair work. But that was last year and nothing has come of it yet.

The legal victory was in the first instance, which means the developers can appeal before a higher court. Quite apart from that, the company is going to declare itself insolvent and go into receivership.

But you can’t tell a moving hillside to be patient and stay where it is – it has other plans.

The Town Hall, who gave the developers permission to build all those houses on unstable land, strangely enough, doesn’t consider that they have a responsibility in all this, and when asked to carry out the stabilization work and then get the money back from the developers, they said that they don’t have the financial capacity to do it.

Fine.

The desperate homeowners have asked the Junta to step in but the silence coming from Sevilla is deafening. They’ve even approached the Central Government in Madrid, but so far, nothing.

So, they have this wonderful peace of paper which says that those accused of building a nightmare are guilty of the whole shambles, but it is just that… a piece of paper

In the meantime, the Spanish legal system is having a race with the subsiding hillside and guess who’s moving faster?
