No, Ladies, it’s not a bargain offer, but a woman who lost part of her compensation claim because she had been window shopping.

The woman stepped into a small manhole lacking a cover and spent 45 days in hospital and has a permanent 14% physical handicap. The incident occurred on the 5th of July 2010 along Calle Hileras in the city centre of Granada.

However, she didn’t get her 44,672-euros compensation because she admitted that she had been gazing at the shop-window displays as she walked.

The result was that the judge considered that she shared 50% of the blame for the accident with the City Hall, who had failed to maintain the pavement and thus eliminating the hazard.

The judge also based his findings on the jurisprudence set by the Supreme Court in 1998 and subsequent cases.

The judge finally awarded the woman 16,624 euros in compensation instead of the 44,672 euros that she claimed.
