Benny’s New Appointment with the Judge

Ex-Mayor of Almuñécar, Juan Carlos Benavides, will stand before a judge, once again, in April next year, but this time to face charges of obstructing the office of the Regional Ombudsman. This is a criminal charge, the like of which has not been seen in the 27 years of this administration’s existence.

According to the Ombudsman, Juan Carlos Benavides during his time in office as Mayor, demonstrated a “systematic and permanent lack of collaboration,” which is typified as obstruction in Artículo 502.2 of the Criminal Law Code.

According to the Public Prosecutor, this ‘lack of collaboration’ manifested itself in six requests from the Ombudsman’s office for information on urban development projects for which he had received complaints. The Ombudsman filed his case against the Mayor in June 2009. On that very same day, the Ombudsman received the requested reports, delivered via a private courier service, however the reports weren’t entered into the office administration’s register until three days later.

Finally, on the 3rd of September, the Ombudsman communicated to the Judge that the reports received supplied the requested information. However, the fact that the ex-Mayor finally sent the required information, apparently upon hearing that he was being denounced before a judge, does not mean that obstruction to the workings of the Ombudsman’s office had not taken place, which is why the trial is going ahead.
