On the 4th of January, 2018, an experienced mountain climber slipped on a dropped pionono cake and received an injury preventing him from ever climbing again.
Of course, the accident did not happen on top of a mountain, but in a cafeteria in the city of Granada. He had got up to go to the toilet and returning to the table had stepped on an individual, pionono cream cake, slipped up, landed badly and ended up in hospital.
Consequently, and as his climbing career came to an abrupt halt, he has been awarded 28,960 euros, which was paid out by the cafeteria’s insurance company.
The climber had claimed that as the floor was wet and covered in the small paper cups that piononos come in, and had not been cleaned up to ensure customers safety, he was entitled to compensation.
Upon slipping up, he fell backwards, hitting the toilet entrance door and a table on the way down, injuring his back. One of the pionono paper bases was still attached to the sole of his shoe.
Staff and customers immediately came to his aid and an ambulance soon arrived to take him to the Hospital Universitario Campus de la Salud in Granada. There he was treated in the A&E ward, where he was diagnosed with “cervical & lumbar trauma, as well as to the right elbow.” The man already had back problems and this accident aggravated his cervical osteoarthritis.
The court took into account his previous condition and considered that the fall “aggravated, destabilised and altered,” his back problems, which directly affected his hobby of mountain climbing.
The insurance company had already paid out 4,500 euros in compensation so that there is another 33,000 euros to be paid over.
What is notable about the judge’s decision was that it not only took into account how long the man was off work and the consequences of his injuries, but that it caused a moral loss to his quality of life.
