A law court in Málaga has found in favour of a road-accident-victim’s family against the Vélez-Málaga Town Hall over the state of the road.
Accordingly, they will have to pay out 52,724 euros to the parents and another 9,586 euros to the brother of young man who died in a motorbike accident caused, the judge considers, by the “terrible state of road maintenance.”
The accident happened in April 2014 when the rider lost control of his machine and collided with a crash barrier and was killed instantly.
The section of the road, according to the Guardia Civil crash report, has numerous bumps and potholes and yet there were no road signs to warn motorists of the fact.
The judge considers that the local authority “neglected its responsibility to maintain the road, thus bringing about an objective and relevant risk for road users.”
One final point, the victim has suffered head and neck injuries that proved fatal but there were also injuries caused by a part of the crash barrier that protrudes above the horizontal panel, for which reason El Defensor del Accidentado calls on the barriers to be modified.
