On the 20th of January, 2012, Iulian S. kidnapped his under-age girlfriend from La Herradura and held her against her will in Otívar.
The girl, who had been hired to look after an elderly woman in La Herradura, had terminated her relationship with the man the previous day. He forced entry into the dwelling after she had tried to prevent him from entering. From there he forced her into a car and took her to Otívar.
Once the girl was locked in a bedroom the man phoned the girl’s father, who was away in Romania, to tell him that he had his daughter and asked whether he wanted him to kill her there and then or cut off her hands and feet and take out her eyes.
An accomplice was involved who had accompanied the man to La Herradura to kidnap the girl. For this man, the Public Prosecutor had recommended three years and 11 months’ imprisonment but the judge acquitted him.
The end to the kidnapping came about after the girl managed to phone the police during a moment when her captor was absent. When the Guardia Civil arrived at the house, he launched himself out the window in an attempt to elude escape, which earned him a stay in hospital under guard.
The judge sentenced Iulian S. to two years’ imprisonment for illegal restraint, plus another six for sexual abuse, taking into account the attenuation circumstance of inebriation.
He also has to pay 5,000 in compensation to the girl and is forbidden from approaching within 500 metres of her in the next 11.5 years.
(Note: technically, it wasn’t a kidnap as no ransom was involved and is classified as illegal restraint)
