The Tribunal Superior de Justicia for Cantabria has rejected an appeal against an expulsion order. The man lodging the appeal had argued that he had put down roots; i.e., was strongly linked to living here.
Without a doubt it is indisputable that his residence in Spain is firm, for the next twelve years, as he is in prison.
The man was found guilty of rape and is currently serving his sentence. He was hoping that once his sentence was up, he could stay in the country, but the Supreme Court does not consider being behind prison bars as having put down roots…
So, it appears that the only place that he will be putting down roots in the years to come will be in the inmate’s gardens.
