The court sentence for a man, who was found guilty of domestic abuse in Motril, was recently upheld by the Provincial Appeals in Granada.
The defendant was sentenced to five months in prison for assaulting his then-partner outside a bar because she was “talking to other men.”

Although the victim was too afraid to testify at the trial, the court ruled that her absence was not a lack of evidence. Her initial police statement and a request for a restraining order were deemed credible.
Thanks to the testimony of police officers who found the victim in a state of distress, and a medical report that confirmed her injuries (hair-pulling, blows to the head, and a hand injury) the court had no problem finding him guilty.
In addition to jail time, the man is prohibited from coming within 200 metres of the victim or communicating with her during 18 months. He also lost his right to possess weapons.
However, the ruling can still be appealed before the Tribunal Superior de Justicia de Andalucía.
