The Provincial Court of Málaga has sentenced a man to a 12-year prison sentence for the September 2023 killing in Barranco de Maro (Nerja).
The victim was brutally beaten with an iron bar on September the 8th, 2023, following an argument; the defendant left his cave dwelling armed with a 90-cm, iron bar and attacked the victim.

The autopsy cited severe traumatic brain injury, multiple fractures, and loss of brain matter as injuries “incompatible with life.”
Following a guilty verdict in February, the court issued the sentence on March the 17th. The judge ruled that the defendant killed his neighbour after a heated argument, striking him repeatedly on the head, chest and limbs.
The court dismissed the prosecution’s request for a murder charge, instead convicting him of manslaughter. The court found no evidence of premeditation or a surprise attack that would have prevented the victim from defending himself.
The 12-year sentence includes a conviction for assault for attacking a second man at the scene, who was struck with the bar and stabbed in the arm before escaping.
The court had rejected the defence’s claim of self-defence, noting there was no proof the victims were armed or that the defendant was attacked first. Evidence showed the defendant intended to kill, continuing the beating while the victim was on the ground, and later photographing the corpse to send to a friend.
Both the victims and the killer were foreigners. This was the second killing in this Maro barranco in less than a year.

Totally agree. Completely bonkers verdict.
I fail to understand how this is not murder. It’s an iron bar and he continued to attack the victim , while the victim was prone on the ground and photographs were taken. If it was a one or two punch situation. Where the victim falls and strikes his head. I could understand Manslaughter. But an iron bar !!
