The Provincial Prosecutor’s Office recommends a 5-year-3-month, prison sentence for a man who shot another in a Motril Park.

The incident took place on the 25th of August, 2022 in the Parque de Los Telares in Motril around 16.30h.

The victim managed to escape his 31-year-old aggressor and hide in the municipal library; the shooter was arrested later that same day.

The trial will take place this month where the accused is charged with attempted murder and illegal possession of weapons.

It all kicked off with a heated argument with the alleged aggressor was being “annoying and insulting” towards several minors present, for which the victim reprimanded him. 

The accused reacted by punching the man, sparking a fight between the two, before leaving the scene while shouting, “Now you’re going to get it!” He returned several minutes later carrying a handgun, allegedly pointing it at the victim and saying, “I’m going to kill you,” before opening fire.

He reportedly fired three shots while the other man was about ten metres away without hitting him, during which the victim took to his heels, zigzagging all the way. One of the shots came uncomfortably close because it hit the tree trunk of a large palm tree behind which he was taking shelter.

The alleged aggressor also took off after the incident, but officers belonging to the Policía Nacional tracked him down to the home of his mother where he lived. Having no nonsense from her wayward son, she confiscated the handgun and handed it over to the police. The accused does not have a firearms permit and the gun belonged to his mother’s brother; i.e., the accused’s uncle, who does have a valid firearms licence.

The accused, has been diagnosed with a moderate depressive episode, as well as a mental and behavioural disorder due to alcohol consumption, was released under a bail sum of 4,000 euros, pending trial.

If found guilty, apart from the prison sentence the Public Proscutor also recommended a 5-year restraining order and six years of probation, including the obligation to undergo outpatient medical treatment or periodic medical check-ups to address his alcohol consumption.
