A union representative asked for several days off from mining company where he worked, supposedly to carry out union duties. He was lying.
As it turns out, he used them to go to El Rocío and celebrate a birthday. The company had hired private detectives to tail him and tracked him to the village of Almonte (where El Rocío is held) wearing the traditional costume for these events and holding a drink…
Strangely… the company immediately fired him upon return but instead of expressing “it’s a fair cop, Gov!” he decided to sue the company – he evidently thought that being a union representative would make them back down. Wrongly, as it turned out.
He had tried to sue them for 30,000 euros in compensation but when the court heard the evidence from the private detectives, which included graphic evidence (photos & videos) they dismissed his claim.
Did he decide that the game was up? No, because he took it to an appeals court in Huelva and lost there, too.
You see, not only did he want paid holiday from work from the 15th of May to the 19th, 2024, but also claimed for the care of a relative undergoing surgery; however, the relative had been discharged from hospital on May the 11th and the husband of this person, who also worked for the same company, had already been granted paid leave to care for her.
So, when he requested paid holiday, Human Resources informed him that the legal requirements for the requested leave were not met and required him to turn up for work. Following this, he informed the company via email that he would use his union credit on May the 15th in his capacity as a union representative. He followed this with another email to say that he would use May the 18th and 19th for the same purpose. He similarly requested union hours for June the 19th (after being denied leave) and the early morning of July the 5th, that year.
The company reacted by hiring a detective agency after the Human Resources manager suspected the man would “use his union leave for personal purposes.” And so it was.
It didn’t stop there with this Feria de Mayo (Rocio) incident because he also took advantage of his union credits to attend two birthday parties, at which point the company decided to open a disciplinary file on July the 9th. As a result, he admitted to these transgressions, offering. “Without forgetting your side of the argument, I ask you to remember we are human and we learn from our mistakes and they can be fixed,” adding, “It’s as easy as sanctioning me.” he argued. Nevertheless, they decided to fire the blighter.
