The plight of Fran Custodio, a resident of Alameda with a 93% disability who was nearly evicted last October from the home where he has lived his entire life, has mobilised locals

In fact, several locals are willing to purchase the property from the investment fund that currently owns it.

One of his neighbours, who representing a larger group, signed a notarised pledge to acquire Custodio’s home at the final price set by the investment entity, which is approximately 40,000 euros. The plan is to grant the property to the current occupant for the remainder of his life before eventually deciding on the future use of the space.

The problem goes back a while; more than four decades, when Fran’s father used the house as collateral for the purchase of another property. A debt of approximately 36,000 euros, which has been subject to successive payment proposals (some even exceeding the pending amount) but ended up in the hands of an investment fund.

Despite receiving offers of up to 60,000 euros, the fund has failed to respond to any settlement proposals.

This situation forced the local Town Council to intervene. Aware of the difficulties in negotiating and the silence from the investment fund, the Council positioned itself as a intermediary. This proposal has now reached the courts in Antequera.

However, the main problem is that the investment fund continues to be unresponsive. Since last October, and even before then, the entity has ignored all proposals made by Fran, his neighbours, and the Alameda Town Council.

A mediator for the fund was involved for several months, according to Mayor José García Orejuela, who pointed out that this person no longer works for the investment fund and that the entity has changed its regional management, to add to the hurdles.

Mayor García Orejuela explained that even the law court itself has taken steps to contact the investment fund. According to García, judicial officials managed to reach the entity, which claims that no formal offer exists for the property.

Both the Mayor and Custodio’s lawyer countered this claim by providing the judge with emails exchanged with the former mediator to prove “that those contacts did indeed exist and that those figures (first 28,000 and then 40,000 euros) had been discussed.”

The law court also has in its possession a petition containing 4,800 signatures from locals who back a suspension of the eviction order.

Editorial comment: If you ever wanted an example of a heartless, souless business arrangement, then you have it in vulture funds. How the hell can they evict this man even when offered money by Good Samaritans in the local community?
