A police motorcycle officer belonging to the Guardia Civil de Tráfico had an accident when his patrol bike slide on a wet surface marking (an arrow), causing him to lose control and fall off.
This occurred in 2020 and as a result of the fall he suffered injuries that meant he had to leave the force.
These surface markings are not anti-slide finished and after rain they are dangerous – every biker knows this.
Therefore, according to the court finding, the marking did not meet the standards required.
The Ministry of Transport had argued that such a fall was inevitable but the judge would not have it because Spanish and EU law stipulates that road markings must be made using materials which are safe.
This accident was not an isolated case, either, as on rainy days white markings on road surfaces are very dangerous for bikers. For this reason the Ministry of Transport will have to pay compensation to this Guardia Civil officer, who lost his job because of his injuries during the course of his duty the sum of
104,517 euros.
Consequently, this court finding has opened the door to bikers in general to sue the State if they suffer a similar accident.
