A man accused of masturbating in a cafeteria in Granada claimed that he suffered from urinary incontenence and wore an adult diaper.

However, the appeals-court (tribunal) judges gave no credence to this claim as a waitress said that he had taken his trousers down and started to masturbate in front of her, or in her words, “he tossed one off” (se hizo una paja).

Consequently, the original sentence handed down by the Court of First Instance stands where he was sentenced to pay a fine of 360 euros and issued a court order to maintain his distance from the said cafeteria, as well as the victim (the waitress) for three months.

The appeals court did take into account a medical report that confirmed that he does in fact suffer from a “loss of control of his bladder” but considers that this has nothing, whatsoever, to do with the events. The defendant had claimed that he had taken his trousers down to adjust the adult diaper, which he had to do in front of her because there were no public toilets in the cafetería.

In fact, his lawyer claimed that it was completely comprehensible that he should touch his genitals in order to straighten this item of protective clothing, as there was no toilet.

The judges consider it proven that the man took advantage of the fact that the waitress was alone in the cafeteria to “perpetrate an obscenity,” leaving the victim with no other alternative than to witness “a repugnant act,” which she could not avoid owing to being taken by surprise. To the contrary, the judges considered it illogical that with his condition he would frequent a cafeteria with no public toilets, as there are many nearby establishments with toilets, thus, they consider, he went their knowing that she was “an ideal victim for his intent.”
