Almuñécar Town Hall has been found guilty of unfair dismissal and ordered to reinstate a worker who was sacked for speaking out.
The member of staff had reported the Town Hall for committing fraud when they hired her.
According to the Motril-court verdict, the Town Hall sacked her just after she submitted the paperwork for a reclamation against them, accusing her employers of fraud in her hiring process as temporary staff.
Furthermore it says that the Town Hall was unable to offer evidence to prove that she was not dismissed as a reprisal for submitting a formal complaint.
It also establishes that the Town Hall was fully aware that the worker was on the point of obtaining a permanent position when they fired her.
For all of the above reasons the judge declared the dismissal null and void and that she should be reincorporated immediately and receive back pay over the period that she was denied employment.
Not only this, but they will also have to pay 1,200 euros in compensation for moral damage (non-material damage).
However, Almuñécar Town Hall has the right to recourse; i.e., can appeal against this sentence before a higher court.
Editorial comment: local tax payers will end up paying for these legal retributions – is it not about time that public employees and politicians who carry out illegal actions pay from their own pockets their errors
