It’s taken four years to get a judicial decision, but at last the judge has sentenced in favour of the affected property owners on Urbanización Carmenes del Mar.

This is only the first instance sentence, so there can be an appeal, but it is still heartening news, nevertheless.

The judge’s findings not only declare all the accused guilty but also sentences them to stabilize the hillside on which the houses stand, which will not come cheap.

This means that the builders, developers and architects will have to run with all of the expenses of this much needed work…. as well as the court costs and expert reports requested during the trial.

The trouble is, if there is an appeal, more time will elapse and it is precisely ‘time’ that is not in abundance as the hillside continues to move, more so with the autumnal rains. For this reason the affected property owners continue to petition the Provincial Delegate for the Regional Government and the Almuñécar Town Hall to do something in the meantime.
