The ecologist groups and several protest groups are not taking the Andalusia Supreme Court’s sentence lying down; a sentence that declared the hotel as having been erected on building land. They are calling for the four judges to be disqualified from the case.

All told 25 separate groups make up the protest platform, Desmontando El Algarrobico, so we’re not talking about half a dozen tree huggers.

The movement also demands that the previous demolition order be carried out immediately and to back this demand they have convoked a protest for the 10th of May.

Desmontando El Algarrobico considers that there have been very serious irregularities during the process before the Tribunal Superior de Justicia de Andalucia, which is why they have lodged ‘objection to the four high-court judges.’ Their consideration is based on the fact that the court’s finding are the complete opposite of all previous findings at lower judicial levels, which has caused “judicial insecurity.”

“The most worrying aspect of this finding is that the these judges have dictated a sentence on the building licence for the hotel, which was declared annulled in 2008 by the Almería provincial law court,” explained the D.E.A.’s spokesperson. They consider that the judges have tried to bring about a 180-degree turn in the process, after the ecologists have knocked up 20 judicial victories in their favour.
