A Disservice to Real Victims?

A woman stands before a magistrate and is looking at 24-months’s imprisonment for having made false claims of sexual aggression. Her victim spent four nights in police cells because of her accusations.

The incident occurred in August 2012 in the city of Granada when Olga S. made a statement before the police against Sergey P. She claimed that that same day he had struck her and attempted to sexually assault her, “forcing her legs open.”

When the case reached the hearing stage she ratified her accusation and the magistrate ordered Sergey P. to be held in custody without bail.

The two had maintained a relationship for several months before the alleged assault and the woman had accused him of gender violence, which led to his having to wear a ankle device to track his whereabouts at all times and a court order to stay at least 500 metres from her.

However, the woman was caught out when she made the second accusation – sexual assault – because the ankle device showed that he was nowhere near where she alleged the attack to have taken place.

Sergio P. is demanding 4,000 euros in compensation for “moral damage.”
