The Mayor of Almuñécar, Trinidad Herrera, called a press conference to make public the court sentence against the Town Hall concerning the charge of alleged unfair dismissal of the Chief Engineer D. Julio Roldán Fontana and the Municipal Surveyor D. José Luis Rodríguez-Passolas Sánchez.
The Mayor said that the Town Council is greatly upset by the judge’s decision, who found in favour of the two ex employees and against the Town Hall. She said that they would launch an appeal at the provincial law court in Granada. The Town Hall shall put forward that they were not permitted to submit reports by experts or testimonial evidence.
The Mayor pointed out that the judge recognised that the majority of alleged wrongdoings had been carried out by the two ex-employees but that dismissal could not be imposed, as the infringements had either expired or that they did not possess the gravity necessary to fire them.
The Mayor states that the Town Hall must show that it is totally against the court findings, whilst at the same name holding the maximum respect for judicial authority.
She said that they would continue with their obligation to carry out the definitive dismissal of the two men, considering that the acts carried out were of such magnitude that there exists no other option other than to terminate their work contracts.
Trinidad Herrera emphasised that since coming to office she and her team have worked hard to give maximum transparency to the workings of the Town Hall.
Finally, the Mayor said that should the appeal be rejected, then the Town hall would pay compensation to both workers but would not readmit them.
