The Mayor came up trumps again when the case against him over the Bahía II hotel in Avenida Juan Carlos was archived. They Mayor had been accused of ‘disobedience’ for failing to annul a First-Occupation Certificate for the hotel upon receiving a court order to do so.
The judge considered that ‘the perpetration of a crime does not appear justified,’ in reference to the Public Prosecutor’s case against the Mayor, which was filed on the 22nd of May 2008.
Naturally, the Mayor is a happy bunny and his party lost no time in pointing out that had the Town Hall withdrawn the F.C.O., they would have been sued by the hotel company, Bahía Almuñécar, if they did not, then they would be taken to court by the Junta de Andalucía – every which way but lose, sort of thing.
