On the 27th of that August a couple assaulted two female employees and the manager of a burger joint – we don’t know in which town nor the name of the establishment.

At the time the lawcourt in Motril found them guilty of assault (and of being obnoxious, probably) but the couple appealed before the provincial appeals court which only confirmed the sentence.

Now it appears that the under-paid, poor-job-outlook staff took too long to present the couple with their order. The ruling specifically mentions “a problem with the order,” but without providing further details, however.

“Bring the bocadillo now, you disgusting woman!” shouted the accused. From that moment on, he and his wife began dealing blows to members of the staff.

The first worker to suffer the nasty couple’s wrath sought refuge inside the premises, but the defendants followed her inside and began attacking her together. Afterward, they got into a scuffle with another waitress and ended up hitting the manager as well.

“During the altercation, the defendants uttered insults and threats to the plaintiffs,” read the court’s findings.

The employee who fared worst suffered “injuries consisting of a cranial contusion, conjunctival hyperemia, scratches on the face and left forearm, cervicalgia, and an anxiety disorder compatible with post-traumatic stress disorder, which took 113 days of moderate personal care to heal, with no long-term effects,” the Provincial Court concluded. Or in plain English, the couple really went to town on her.

In this regard, the couple must compensate the affected worker with “8,216.72 euros.”

As for the other two victims, the other female employee had scratches on her nose, a “bruise” on her “scalp,” and “pain in the rib area.” Meanwhile, the restaurant manager was treated for a blow to “the right frontal area with significant swelling and redness,” “pain upon palpation” in a finger on his left hand, and in a foot.

So what did the judge hand down to the repugnant couple? It was as follows: for the accused male: “Three minor offenses of injury, for each of which a penalty of a 30-day fine at a daily rate of six euros (180 euros) is imposed,” and, in the event of non-payment of this financial penalty, “he will be subject to one day of deprivation of liberty for every two unpaid installments.” The woman was convicted as the perpetrator of a single minor offence of injury, carrying another “30-day fine” under the same conditions as her husband.

Regarding civil liability, and in addition to the 8,216 euros to be received by the worker who suffered the most significant injuries, the defendants must compensate the remaining victims with 313 euros and 479 euros, respectively.

One of the lawyers involved in the proceedings appealed the sentence before the Provincial Court to reduce the compensation amount of 8,216 euros and requested that a forensic expert be heard.

The court has rejected these claims. Regarding a potential reduction of the compensation, the Provincial Court states that “there is documentary evidence supporting the conclusion reached by the magistrate, such as the emergency and assistance reports and the medical reports issued by the doctors.” On top of that, the defence lawyer also buggered up the appeal format.
