Another Blow for the Town Hall

Almuñécar Town Hall has lost another case concerning providing coverage for urbanizaciones within the municipality; this time, Punta de la Mona.

LHR Punta de la Mona 02 400x250According to the court sentence, the Town Hall is now responsible for the maintenance and infrastructure of Urbanización La Punta de la Mona-Los Berengueles.

This blow comes shortly after a similar sentence that made Urbanización Cotobro their responsibility, as well.

In the case of Cotobro, since 1988 a private, collective entity, ECCO, guaranteed the maintenance needs of the residents of the said urbanizacíon.

The Tribunal Superior de Justicia de Andalucía handed down a sentence at the end of February in favour of the Comunidad de Propietarios Punta de la Mona-Los Berengueles and ordered the Town Hall to “immediately assume responsibility of the urbanización in its present state.”

The Town Hall had been trying to make the residents of the owners association pay for the infrastructure repairs out of their own pocket, however, the wording of the sentence has put a stop to that.

The main opposition party has urged the Mayor to immediately assume responsibility of both urbanizaciones without delay or procrastination but the Mayor has responded that these things take time.

    Lynne: that depends on whether the Comunidad de propetarios has taken the Town Hall to court for it to assume maintenance etc. These two owner associations won their cases to achieve this.
