Junta Pays Out to Farmer over Flood Damage

Calahonda ramblaA judge has sentenced that the Junta has to pay compensation to a plastic, greenhouse owner in Calahonda over flood damage. The riverbed (rambla) had not been cleared adequately of vegetation.

It was in November 2011 when a cloud burst caused a torrent to descend the rambla, causing 22.897 euros in damage to a nearby greenhouse, when it broke its banks.

The judge considers that the Junta failed to maintain the riverbed clear of vegetation, whereas the Junta had claimed in its defence that the rainfall was torrential during several hours, that they had indeed cleared the riverbed and that there had been other contributing factors such as a lack of adequate drainage where the N-340 goes over the said rambla.

The judge did recognise that the N-340 drainage was a factor and that other greenhouses had encroached up on the rambla, which is why he sentenced the Junta to pay part of the damages; i.e. 17,173 euros.
