A man, who allegedly sold his dementia-sufferer father's farm and kept the 61,000-euros from the sale, is facing a recommendation by the Public Prosecutor of four years' imprisonment.

A man, who allegedly sold his dementia-suffering father’s farm and kept the 61,000-euros from the sale, is facing a recommendation by the Public Prosecutor of four years’ imprisonment.

The Prosecutor’s office expounds that the father was diagnosed as having Alzheimer’s, which according to a medical expert, badly affected his cognitive capacity.

As the father’s condition worsened, his daughter applied for a ‘declaration of incapacity’ and then, following this in July 2021, the court confirmed his total incapacity.

She was give power of attorney and when she took control of his estate she discovered what had been happening; in 2020 her brother had allegedly sold one of his father’s land properties in Deifontes; a 30,000-sq/m olive plantation.

He had taken his father and mother before a notary to formalise the sale worth 70,000 euros, while it was really valued at 103,000 euros. He then went with his father to the bank so that The father could transfer the money over to this account.

The daughter’s investigation found that their father had also transferred 40,000 euros and 27,000 euros to her brother even though his father at the time had been diagnosed with Alzheimer’s.

The Prosecutor considers that all of this resulted in the loss of his father’s patrimony, causing considerably economic damage to both the father and the mother; funds that should have been going towards covering the extra costs of the father’s care.

This situation came to the Public Prosecutor’s desk after the daughter sued her brother, as well as the notary involved and the couple who had bought the farm. However, the Prosecutor does not consider the notary or purchasers as responsible, so their involvement has been provisionally shelved.

Finally, the accused also faces a 3,600-euro fine.
