TSJA Rejects Junta Appeal

The Andalusian High Court has rejected an appeal against its previous findings ruling out a Covid passport for night-bar sector.

AND judge OnLThe TSJA considers such an obligation to be too “intense and extensive” where individual’s rights are concerned.

In other words, the Corte Supremo considers for this restriction to be valid it must be to protect public health in a specific, indespensible instance rather than a blanket preventative measure.

Or putting it another way, it can’t be applied to the whole of Andalucía indiscriminately, as the Junta intended without even taking into account a municipality’s contagion rate. Hence the term “too extensive.”

In recent months regional supreme courts have thrown out such moves (Covid passports) in the Canary Islands, Andalucía, Cantabria and Galicia. All of them, with the exception of Andalucía, accepted the finding with only Andalucía presenting an appeal.
