Sexual Abuse Case Shelved

ALM Lawcourts 01 OnLThe Almuñécar law courts have decided to shelve the case against a man who worked in the Municipal Youth Department for sexual abuse against a minor.

Two youths, one of whom is a British citizen, reported the accused for molesting the younger of the two, a minor.

This occurred in September last year. The man gave up his public post whilst defending his innocence, also claiming that the accusations were an attempt to blackmail him over his homosexuality.

The original magistrate released the man without bail pending trial, which will not take place as on the 8th of February the case was shelved. The magistrate considers that the perpetration of the said crime has not been sufficiently demonstrated and that therefore the case is to be provisionally shelved. She also returned his confiscated possessions, such as a computer and a tablet.

The 42-year-old man says that he is relieved after having lived through hell.

“Seeing yourself under investigation because of a false accusation is always unfair and disagreeable, if it were for theft or something like that, but to see yourself accused of such an ugly and disgusting crime, will always leave a stain against your name,” he explained.

“I lost everything; I lost my job, my income, but the worst is not the economic side but the social stigma that I have had to suffer. I was arrested and had to spend a night in a cell – you don’t forget those things,” he added.

Finally, he said that it was now his turn to sue the two youths for slander, for the moral damage to his person.
