A judge handed down a sentence of 3-years’ imprisonment to a woman driver who had knocked down a father and his young son as she chatted on a mobile. She was also speeding in a 30-km, speed-limit area.
The incident occurred on the 28th of November, 2011 when a 45-year-old father and his 7-year-son were killed on Calle Rodeo in the centre of Málaga. The driver had been speeding as well as holding a conversation on her mobile telephone.
Phone records proved that she was using the apparatus at the time of the accident (17.23h), even though she denied that she had been speaking on the telephone and that she had made the call immediately afterwards.
The deaths were caused when the woman lost control of the vehicle and swerved up onto the pavement where the victims were walking.
The judge considered that she was guilty on two counts of manslaughter and a count of causing injuries to a third person; the father’s other son. Furthermore, as she used that route everyday to pick up her kids from a nearby school (see photo of narrow street and school) the judge had no doubt that she was well aware of both the 30km speed limit and the amount of pedestrians (including schoolchildren) on the street at that time.
Consequently, he sentenced her to a 3-year prison sentence and ordered her driving licence suspended for a further six years. She will also have to pay the family (what’s left of it) of the victims half a million euros in compensation.
