It appears that the Junta de Andalucia has lost its appeal against the building licence issued in 2005 for twelve dwellings on San Antonio in La Herradura.
The building licence had been granted to Solymar Levante S.L. for the construction of a dozen terraced houses within Urbanización de San Antonio on the 19th of July, 2005. The Junta took the Town Hall to court over it and lost the case at Nº3 Court in Granada in November 2009 but subsequently lodged an appeal at the Tribunal Supremo de Justicia de Andalucía.
The CA (Sr. Benavides’s party) considers that this judicial decision undermines the justification used by the present-day Mayor for the dismissal of the Town Hall Chief Surveyor; i.e., that he hadn’t been doing his job properly.
Editorial Comment: Regardless of political point scoring between parties and administrations, the fact of the matter is that the dwellings are completely out of character with the venerable Urbanizacíon San Antonio, and in the view of many, a complete eyesore, yet they are now there to stay; stark testimony to the greed-driven excesses of the recent building bubble.
