German Man Accused in Salobreña

A retired German man is facing a 16-year jail sentence for alleged illegal detention, sexual aggression and bodily harm to a woman of the same nationality. According to the accused, it was the woman who denounced him that had wanted to maintain sexual relations.

The incident occurred in March 2010 in Salobreña, starting whilst both of them were in the accused’s home. According to the victim, she had gone around to his house – a neighbour of hers with whom she maintained a cordial friendship – only to find herself tied up on a bed, where she claimed she was sexually abused. Furthermore, she says that he prevented her from leaving from 14.00h to well into the evening by keeping her with her hands tied, whilst at the same tied to the bedstead by her neck.

The man, on the other hand, denies completely the charges, claiming that she had tried to convince him to stay in the country, as he was due to leave the next day for Germany in order to look after his sick wife. It was she, he claims, that wanted to have sexual relations with him and that out of revenge, she had made this false accusation before the police.

Again, back to the woman’s version, he had escorted her back to her own house, and just when she was starting to feel safe, he threatened her with an axe until she let him into her house, where he reportedly detained her until 07.00h. The accused states that he was there with her consent and he only tied her up once, when she became violent, attempting to harm him with a knife.

The Guardia Civil inspected both houses and found that the door to the woman’s house had marks on it, consistent with blows from an axe. They also confirmed that the woman had marks on her that proved that she had been tied up. Forensic medical investigations demonstrated that the woman had injuries to the outside of her vagina, as well as to her face and wrists and that the woman was suffering from post-traumatic stress.
