Our Fermín Tejero, leader of the local IU party and part owner of the Camping Carambolo isn’t having much luck with nailing the Mayor, in a judicial sense… who is?
The provincial law court has ratified the Almuñécar law court’s decision to shelve the case against the Mayor, which had been lodged by Fermín. Camping Carambolo had denounced the Mayor for abuse of authority in his actions against the installations. When the Almuñécar court threw it out, he appealed against this decision. Little good it did him because Granada considers that there are ‘no indications of criminal behaviour.’
But let’s get this straight: the judge considered that no crime had taken place therefore the case was inapt for criminal proceedings, which does not mean that the Mayor and his then Councillor for Urban Development, Emilio González had acted legally. In other words, the case should have been presented under the Civil Code, rather than the Penal Code. Fermín Tejero had obviously gone for the criminal courts because the return of a guilty sentenced would have resulted in imprisonment and barring from office, rather than economical sanctions.
Anyway, it all goes back to 2005 when Camping Carambolo denounced the Mayor for harassment, after the Town Hall ordered the camp site to be closed down – it’s been closed ever since. Now I said earlier that ‘it should have been presented under the Civil Law code… and it was. Not only that, but the camp site won, but the Town Hall has not let it re-open despite the court finding, hence going for the Penal Law path…
