Urbanización Cotobro Sentence

The top, regional law court, the Tribunal Superior de Justicia de Andalucía, has sentenced Almuñécar Town Hall to take over the responsibility of the said urbanización.

Accordingly the Asociación de Propietarios de Cotobro has asked Mayor Trinidad Herrera to abide by the court sentence and assume responsibility for the maintenance of Urbanización Cotobro, which has hitherto been the responsibility of ECCO (Entidad Urbanística de Conservación de Cotobro).

It was in 1986 that ECCO was set up to cover the maintenance of the urbanización’s infrastructure. The administrative side has been handled by the Almuñécar company, Asinex, since ECCO was founded.

The residents are from over 20 different countries and together with Urb. Los Pinos and Urb. Punta de La Mona, represents the more affluent areas of the municipality.

Furthermore, the main opposition party, the CA, will take the affair to the next Plenary Meeting of the Town Council, urging the Mayor to abide by the court sentence forthwith, dissolving ECCO and extend funds from the municipal budget for the repair and maintenance of the streets within the urbanización , some of which are in a bad state of repair, according to the CA.

The motion also includes the obligation on the part of the Town Hall to communicate this new arrangement to the Mancomunidad and Aguas y Servicios, so that the “appropriate measures can be undertaken.”

Editorial comment: the Mayor has a reputation of dragging her feet when it comes to carrying out judicial decision; a clear case in point is the hotel structure at the western entrance to Almuñécar, on the N-340. Even though the highest court in the land has sentenced a few years back that it must be demolished, for which there can be no appeal, this has not been carried out.
