A Public Prosecutor handling a case in the Málaga law courts recommended eight years' imprisonment for three tourists accused of sexual assault against a woman in their tourist flat.
Actually, to be more precise, they are accused of sexual assault and sexual abuse in this incident that took place in June 2021.
The accused men are German citizens, one of whom had met the woman some days previously and had arranged to met up with her via a social media platform. After having met up in the city, they went back to the flat that he and his friends were renting for the duration of the short holiday stay.
The two of them had been chatting and drinking alcohol until the other two accused arrived. When they did, the ‘couple’ went to his bedroom. However, they had not only consumed alcoholic beverages but also cocaine as well as smoking pot, according to the Public Prosecutor.
Whilst they were sexually involved, the two other men entered, stripped and started taking photos, ignoring her protests and unwillingness to continue: she shouted “stop” repeatedly, which is a readily understood word in Spanish, German and English.
According to the Public Prosecutor, despite her pleas, they went ahead and sexually assaulted her.
She then left the flat with the first man, who said that he would accompany her home, given her state, but after walking some way with her, he ran off, leaving her alone, drunk, high and distressed in the early hours of the morning.
Apart from the imprisonment terms, the Public Prosecutor also recommends a fine of 2,000 euros each.
