Two officers belonging to the Marbella Policía Local were arrested, accused of allegedly committing sexual aggression against two women.
The officers, who are also charged with bribery, are being held in custody, pending the trial in Marbella.
The incident took place on the 12th of July involving two young, South-American women in their 20s. However the victims did not report the incident until the 31st of the same month; one in Estepona and the other in Madrid.
The case was investigated by the Unidad de Familia y Atención a la Mujer (UFAM) belonging to the Marbella police station, as that was the town where the incident allegedly occurred.
Both officers were on duty on the 12th near the municipal border between Marbella and Estepona on a plain-clothes patrol in an unmarked police car, which was when they came across the two women and asked them for their IDs. Neither women was legally entitled to be in the country.
Some hours passed and the officers, having officially finished their shift, took them to a secluded area where one of the officers had sex with one of the women, whilst the other officer did the same with the other woman, according to the victims.
The main evidence against the officers is an audio recording secretly made by one of the women because she had activated the microphone on her mobile and recorded all the conversations between the officers and the women.
The victims claim that they were coerced into having sex with the officers with promises that their legal situation in Spain would not be reported.
The officers were ‘interviewed’ by UFAM staff on the 5th of August, where they were informed that they were going to be charged. That same day they were brought before a magistrate who ordered that they be held in custody until trial.
The officers, on the other hand, had argued that the sexual relations were consented at all times. Their defence lawyer advised them to make no further comment until trial.
