False Sexual Abuse Claims

The Criminal court Nº1 in Granada has sentenced a woman to five-years' imprisonment for falsely accusing her ex-husband of sexually abusing their daughter.

GRA Criminal Law Court Nº1 BShe has also been barred from exercising parental custody for a period of ten years as the judge considers that the situation has “affected the daughters psychological balance” because of the unnecessary and continuous medical examinations.”

Judge Manuel Piñar also ordered her to pay 40,000 euros in compensation to the minor and the same amount to the father, whom she is forbidden from approaching within 500 metres during five year.

The judge also considers that the child had lived with her parents “without abnormal incidents,” until they separated in 2017. However, in 2018 when the father requested visiting rights as part of their divorce settlement, the accusations had begun.

She can appeal against this finding.

    Nick: the press release does not clarify that although logically it must run following her release from jail. Also bear in mind that she will probably serve about half the prison sentence only. In the meantime, her lawyer announced that she would appeal.

    I don’t understand the logic of the 5 year restraining order the Judge has given out, if the woman is being imprisoned for 5 years, unless it comes into effect once she is released????
