A sergeant belonging to the Guardia Civil in the city of Granada has been suspended two days without pay for not taking his car for an ITV when instructed to.
The patrol car should have gone for its test on the 19th of July 2018 and failure to do it is considered a minor infraction according to the Guardia Civil Standing Orders. The punishement was ratified by the
Sala Militar del Tribunal Supremo (TS).
The sergeant justified his failure to carry out an order because on that day he was absent owing to a relative having to be hospitalised. However the military tribunal considered that even though he had been given the day off, he could have contacted his post and found somebody else to do it.
The problem was that as the patrol car had missed it’s ITV, it had to be immobilised and couldn’t be used for its assigned task for that day. In fact, it was ‘out of action’ until they could get another appointment, which was on the 2nd of August.
