There’s been a huge change to Spanish divorce laws which will cause an earthquake where the family home is concerned.
The spouse who has custody of the child or children and therefore has the use of the family home will now forfeit that right if a new partner moves in.
In effect, the other spouse can ask the judge to dissolved the community estate; i.e. joint estate, in order to sell the house, in which case the spouse in residence will either have to move out so that the house can be sold, or buy out their ex-partner.
The Asociación Española de Abogados de Familia (Spanish family-lawyer association) praised this legal change, fruit of a Supreme Court sentence, because it has “done away with many unjust situations, which beneath the umbrella of protecting a minor, gave rise to rights abuses.”
