The provincial law court of Córdoba has upheld the sentence of manslaughter against Sr. M.R.S.D., who received a 2-year prison sentence for the shooting of an ex Nerja councillor, during a monteria (game shoot) in 2006.
The incident occurred on a large estate on Dehesa del Alcornocal, near Posadas in the province of Córdoba. Both men were taking part in the hunt, placed in adjacent shooting booths when the accused man fired directly in the direction of his neighbour, ex-Councillor José Luis Pezzi, who served in the Nerja Town Council between 1995 and 2003.
The original court sentence mentioned the fact that the victim had moved his post 1.9 metres closer to the man who fired the shot, which was why the family of the victim appealed against this observation. The Appeals Court decided that this fact was irrelevant, as the shot was going in that direction anyway and that besides hitting the victim, it also tore the trouser leg of the victim’s shooting companion in the same booth.
As well as the prison sentence, Sr M.R.S.D., has also been ordered to pay court costs, compensation to victim’s family (quantity not stated) and has been banned from holding a firearm licence for three years.
